TaleLark.AI Terms of Service

Account Creation

To use TaleLark.AI, you must create an account by providing accurate, complete, and current information. You agree to update your information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Age Requirements

You must be at least 18 years old to create an account and use TaleLark.AI. Our service is not directed to children, but rather to parents and guardians who create content for their children.

Account Security

You must notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Your Content

You retain ownership of any information, preferences, and inputs you provide to TaleLark.AI ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your User Content solely to provide and improve our service.

AI-Generated Stories

Stories generated through TaleLark.AI are created using artificial intelligence based on your inputs and preferences. Subject to these Terms, you have a non-exclusive license to use the generated stories for personal, non-commercial purposes for your family. You may not sell, redistribute, or commercially exploit the generated stories without our prior written permission.

Content Representations

You represent and warrant that your User Content:

• Does not violate any applicable laws or regulations
• Does not infringe on the rights of any third party
• Does not contain harmful, threatening, or inappropriate material
• Is accurate and truthful to the best of your knowledge

Content Removal

We reserve the right to remove or refuse to process any User Content that violates these Terms or that we deem inappropriate, at our sole discretion.

Platform Ownership

TaleLark.AI, including its design, features, functionality, code, and all related intellectual property rights, is owned by Ask DAO, LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

License to Use Service

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use TaleLark.AI for your personal, non-commercial use. This license does not include any right to:

• Resell or commercially use the service or its content
• Collect or use any product listings, descriptions, or prices
• Make derivative uses of the service or its content
• Download, copy, or extract data using automated means
• Use the service for any commercial purpose without our permission

Commercial Use

If you wish to use generated stories for commercial purposes (e.g., publishing, selling, or public distribution), you must contact us at [email protected] to obtain a separate commercial license.

Trademarks

"TaleLark.AI" and related logos are trademarks of Ask DAO, LLC. You may not use these trademarks without our prior written permission.

Subscription Plans

TaleLark.AI offers various subscription plans with different features and usage limits. Subscription fees, features, and limitations are described on our pricing page and may change from time to time.

Payment

You agree to pay all fees associated with your subscription plan. Payments are processed through third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees to that payment method.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee for the renewal period.

Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to paid features until that time. We do not provide refunds for partial billing periods or unused services, except as required by law.

Price Changes

We reserve the right to change our pricing at any time. Price changes will apply to your next billing period after we provide you with at least 30 days' advance notice.

AI-Generated Content

TaleLark.AI uses artificial intelligence and machine learning technologies to generate story content. While we strive to produce high-quality, appropriate content, AI-generated content may:

• Occasionally contain errors, inconsistencies, or unexpected elements
• Not always perfectly match your expectations or intentions
• Require review and editing to ensure appropriateness
• Vary in quality and creativity

No Guarantees

We do not guarantee that AI-generated stories will meet your specific requirements or be free from errors. You are responsible for reviewing all generated content before sharing it with children.

Third-Party AI Services

TaleLark.AI uses third-party AI services (including OpenAI, Anthropic, Google, and xAI) to generate content. These services have their own terms and policies, and service availability may be affected by these providers.

Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through your account settings or by contacting us at [email protected].

Termination by Us

We may suspend or terminate your access to the service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. We may also terminate inactive accounts.

Effect of Termination

Upon termination, your right to use the service will immediately cease. We may delete your account and all associated content. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, and dispute resolution provisions.

Informal Resolution

If you have any dispute with us, you agree to contact us first at [email protected] to attempt to resolve the dispute informally before pursuing any formal action.

Binding Arbitration

If we cannot resolve a dispute informally, any dispute arising from or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between you and Ask DAO, LLC individually. To the fullest extent permitted by law, you waive any right to pursue disputes on a class-wide basis or in a representative capacity.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ask DAO, LLC regarding the service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or failures of third-party services.
